How we work with you.
The terms behind every quote, website build and upkeep plan, written in plain English. No surprises here either.
1. Who we are
Tyne Webcraft is a web design studio run by Michael Wake and Arlo Bell in Newcastle upon Tyne, England. Address: Newbiggin Hall Centre, Newcastle upon Tyne NE5 4QH. Email: [email protected]. Phone: 07432 832866. These terms apply to every quote we give and every website build, rescue, custom project and upkeep plan we carry out. By accepting a quote or paying for our work you agree to them.
Our services are designed for businesses. Nothing on this website is a contract in itself: the price and scope of your project are confirmed in writing in your quote. If you are buying as a consumer, nothing in these terms takes away your statutory rights.
2. What is included
The website package is described on our pricing page: a design of your own, the pages you need, the words written with you, the site set up to work well on every device and in search engines, any specific needs you have agreed with us for your website, a contact form, domain set-up and launch. Anything outside that, such as online shops, custom features or extra pages after launch, is quoted separately before we start.
The monthly upkeep plan covers hosting, updates and security patches, regular backups, keeping everything we built for you working, and reasonable small changes such as new prices, photos or opening hours. Larger changes, redesigns and new sections are quoted separately. We will always tell you before any work that would cost extra.
3. What we need from you
You supply the material that goes on your site: your text where you want to write it, your photos, your logo, your prices and your business details, and you check and approve the words we write with you before launch. You confirm that you own this material or have permission to use it, and that it is accurate and lawful. That includes any customer reviews, qualifications, accreditations and claims about your business. If we are asked to remove something from your site because of a complaint about your material, we may do so without liability to you.
We need your feedback to keep a build moving. If we are waiting on you for more than 30 days we may pause the project and resume it when you are ready; the price agreed still stands.
4. Payment
- The website build is free when you take the upkeep plan. There is nothing to pay until your site goes live.
- The upkeep fee of £30 a month is payable monthly in advance from the day your site goes live. There is no minimum term.
- We are not VAT registered, so no VAT is added to our prices.
- Prices shown on the site are the prices at the time you accept a quote. We may change the upkeep fee for the future by giving you at least 30 days' written notice; you can cancel before the new fee applies.
- If a payment is more than 14 days late we may, after a written reminder, pause work or suspend hosting until the account is settled.
5. Cancelling the upkeep plan
You can cancel at any time by email; the plan ends at the end of the paid period. If a payment is missed and not settled within 14 days of our reminder, the plan ends too. Because the build is free, the website is part of the plan rather than something you have bought: when the plan ends the website is taken offline and stays ours. Within 14 days we return the material you supplied to us (your logo, photos and text), and we transfer your domain name to you where it is registered in your name or you ask us to. If you later want the website back, we can usually restore it when the plan restarts.
6. Who owns what
The website we build for you is provided as part of the upkeep plan, not sold to you: the design, code and the words we write stay ours, and you have the right to use them for as long as you are on the plan. The material you give us, such as your logo, photos and your own text, stays yours. Your domain name is registered in your name wherever the registrar allows it. Items from third parties, such as typefaces, stock images and software libraries, stay under their own licences, which we choose so that you can keep using them. We keep the right to show the work in our portfolio and to describe it as ours, unless you ask us in writing not to.
7. Our responsibilities, and their limits
We will carry out the work with reasonable skill and care, keep your site backed up while it is on an upkeep plan, and tell you promptly if something goes wrong. If work we have done is faulty we will put it right at no charge.
Search engines, social networks and hosting companies are outside our control. We make no promise of a particular search ranking, number of visitors, enquiries or sales, and we are not responsible for downtime, data loss or other problems caused by third-party services, by your own material or changes, or by events beyond our reasonable control.
We are not liable for loss of profit, business, revenue, goodwill or anticipated savings, or for any indirect or consequential loss. Our total liability to you for any claim, however it arises, is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
8. Demonstration sites
The mockups on our Our Work page marked "Demo mockup" are illustrations of what we can build. Their businesses, prices and reviews are examples, not real offers. Sites marked "Live client site" belong to the clients named and are shown with their agreement.
9. Problems and complaints
If something is not right, email us and we will respond within two working days and work with you to sort it out. These terms are governed by the law of England and Wales, and any dispute that cannot be settled between us will be dealt with by the courts of England and Wales.
10. Changes to these terms
We may update these terms from time to time. The version in force is the one on this page on the day you accept a quote, and we will tell current upkeep clients by email before any change affects them.
